Digital Skills Bootcamp and Events 2024 - Terms and Conditions

By attending the ‘Digital Skills Bootcamp and Events 2024’ provided by PwC Academy Limited, a private limited liability company registered under the laws of Malta, with registration number C83606 (“PwC’s Academy”), the course attendee agrees to comply with the following terms and conditions and any other document which is supplemental hereto or collateral herewith of PwC’s Academy (“Agreement”).

1. Definitions and interpretation

1.1  In this Agreement, the following expressions shall have the meanings set out below, unless the context otherwise requires:

1.1.1  “Attendee” means the person registered to attend the Training Programme in the Registration Form;

1.1.2 “Training Programme” refers to either one or more, where applicable, of the following training programmes delivered by PwC’s Academy in respect of the Digital Skills Bootcamp & Events 2024:

1) Cybersecurity to the Next Level – A training course for IT professionals working in SME’s consisting of the following sessions:

Session 1: 19th July 2024 – Securing the IT Environment through Cybersecurity Methods (1.5 hours) – in person;

Session 2: 23rd July 2024 – Peer coaching and mentoring on Implementing Cybersecurity Practices (45 minutes) – online, instructor led; and

Session 3: 6th August 2024 – Peer coaching and mentoring on Implementing Cybersecurity Practices (45 minutes) – online, instructor led.

2) Navigating Digital Transformation: Equipping Leaders for Transversal Excellence – 16th October 2024

3) The Future of Data-Driven Automation – Alteryx – 07th November 2024

1.1.3  “Registration Fee” refers to the below charges in relation to each Training Programme:

1) Cybersecurity to the Next Level – A training course for IT professionals working in SME’s
– fifteen Euro (€15) payable by the Attendee to PwC’s Academy for attending the relevant Training Programme;

2) Navigating Digital Transformation: Equipping Leaders for Transversal Excellence
– ten Euro (€10) payable by the Attendee to PwC’s Academy for attending the relevant Training Programme;

3) The Future of Data-Driven Automation – Alteryx
– ten Euro (€10) payable by the Attendee to PwC’s Academy for attending the relevant Training Programme;

1.1.4  “Registration Form” means the PwC’s Academy registration form and any document ancillary or supplemental thereto which is to be submitted by any Attendee wishing to attend the Training Programme.

1.2  Other terms used in the Agreement are defined in the context in which they are used and shall have their respective meanings there indicated.

1.3  The headings and expressions in the Agreement are for reference only and shall not affect its interpretation.

2. Registration

2.1  Registration constitutes a request by the Attendee to apply for and attend the Training Programme and acceptance of this Agreement.

2.2  Such request shall not result in a Training Programme booking/ reservation unless and until full payment of the Registration Fee has been received and successfully processed and verified by PwC’s Academy.

2.3  Any registration made via the telephone or via electronic means shall, upon confirmation thereof by PwC’s Academy, be deemed to be tantamount to the submission of a Registration Form and shall be subject to the terms herein.

2.4  PwC’s Academy reserves the right to reject any subscription request or terminate subscriber accounts at any time without notice and/or need to give any reason or refund to the Attendee.

3. Fee(s) and payment

3.1  Unless otherwise agreed to in writing by PwC’s Academy, the Attendee shall settle the Registration Fee upon registration for the Training Programme. In the case that full payment has not been settled within ten (10) days from the date of submission of the registration form, PwC’s Academy reserves the right not to provide the Attendee access to the Training Programme.

3.2  The Registration Fee will be fully refunded to the Attendee by PwC’s Academy following successful completion of the Training Programme. For an Attendee to qualify as successfully completing the Training Programme, the Attendee must attend at least 80% of the total time of the Training Programme.

3.2.1  In order to benefit from the abovementioned refund, the Attendee hereby agrees to PwC’s Academy collecting attendance evidence throughout the Training Programme, irrespective of whether such evidence is in electronic or physical format, and share such evidence with eSkills Malta Foundation.

3.3  The time period scheduled for each Training Programme includes meal and/or refreshment breaks and questions on aspects of the Training Programme’s contents.

3.4  In the event that the Training Programme content is completed within the allocated time period thereby resulting in an early finish, no adjustment to the Registration Fee may be requested and in no such case will PwC’s Academy grant a refund.

4. Cancellation and transfer

4.1  The Attendee may cancel any registration for a Training Programme by directly notifying PwC’s Academy in writing at mt.academy@pwc.com, by no later than ten (10) business days before the commencement of the relative Training Programme.

4.2  In the event that the Attendee fails to provide written notice for cancellation within the above stated time period, the full Registration Fee for the Training Programme shall remain chargeable and no refund will be granted to the Attendee.

4.3  PwC’s Academy reserves the right, at any time and for any reason, to cancel or reschedule the date allocated for the Training Programme. In the event that a Training Programme is cancelled or the Attendee will not be able to attend the said Training Programme on the rescheduled date, PwC’s Academy shall provide the Attendee with a full refund of the Registration Fee paid for the cancelled or rescheduled Training Programme and there will be no further liability upon PwC’s Academy.

5. Duties of client

5.1  In order to be eligible to enrol and participate in the Training Programme, the Attendee must be a resident of Malta.

5.2  The Attendee agrees and undertakes to attend the Training Programme in person and/or online as may be necessary and directed by PwC’s Academy at its sole and absolute discretion.

5.3  PwC’s Academy reserves the right to terminate a subscription of any Attendee and preclude that Attendee from attending any Training Programme at PwC’s Academy’s reasonable discretion. The relevant Registration Fee shall in such instances not be refundable in whole or in part to the Attendee.

5.4  The Attendee agrees to participate at the end of the Training Programme in a survey which assesses the quality of the training and its contents. The Attendee further agrees that failure to participate in such survey shall result in non payment of the refund outlined in terms of clause 3.2 above.

6. Travel and accommodation

6.1  The Attendee is solely responsible for all travel arrangements, accommodation requirements and other costs relating to attending any Training Programme provided by PwC’s Academy.

7. Warranties and liability

7.1  PwC’s Academy will use reasonable endeavours to ensure that the Training Programme provided is dispensed with reasonable skill and care and will follow practices consistent with the professional standards in the industry. PwC’s Academy reserves the right to change the course content of any Training Programme at any time and without notice.

7.2  The Attendee shall indemnify and hold harmless PwC’s Academy, its partners, directors, agents and employees, from and against all claims, actions, demands, losses, costs, expenses (including, without limitation, all legal fees and disbursements), damages, liabilities and lawsuits arising from any breach of the Attendee’s obligations under this Agreement.

7.3  In any case whatsoever, PwC’s Academy’s total liability in contract, tort or otherwise shall not exceed one (1) times the Registration Fee paid by the Attendee for the Training Programme in respect of which the claim is made.

8. Intellectual property rights

8.1  The copyright in and all other intellectual property rights relating to the Training Programme software, data and documentation employed by PwC’s Academy and any related materials (“Programme materials”) provided to the Attendee by PwC’s Academy are owned exclusively by and hereby reserved to PwC’s Academy and/or its party licensors. PwC’s Academy hereby grants to Attendee a non-exclusive, non-transferable, non-sub-licensable licence to use such Programme materials solely for the purpose of receiving the Training Programme.

8.2  Under no circumstances may any part of the Training Programme materials be produced or copied in any form or by any means, or shared with any third party, or translated into another language by the Attendee without the prior written permission of PwC’s Academy.

8.3  The Attendee shall not delete, amend, alter or deface any confidentiality or proprietary notices on the Training Programme materials.

9. General

9.1  The Training Programme and any Training Programme materials provided are not intended to be a definitive or comprehensive analysis of the subject matter and should not be deemed to constitute a substitute for professional or legal advice.

9.2  The sessions of the Training Programme may be delivered by PwC’s Academy either in person or online at the sole discretion and direction of PwC’s Academy.

9.3  This Agreement shall apply without prejudice to any other specific provision, clause or term stipulated by PwC’s Academy. For the avoidance of doubt, other terms and conditions may apply to this Agreement, in particular the legal disclaimer published on the website of PwC’s Academy.

9.4  PwC’s Academy shall not be held liable under this Agreement in circumstances where, because of a fortuitous event in consequence of an irresistible force, including, but not limited to, any natural disasters, fire, flood, strike, industrial dispute, war or similar action, act of terrorism, uprising, or acts of governmental authority. It is prevented from performing its obligations under this Agreement due to circumstances beyond its control.

9.5  Any notice required under this Agreement shall be in writing and deemed received on the next business day following its transmission.

9.6  The Attendee accepts and agrees to be contacted by PwC’s Academy via email in order to confirm the Attendee’s registration to the Training Programme and to provide any updates or notices related to the Training Programme.

9.7  If any provision of this Agreement is held by any competent authority or court to be invalid or unenforceable in whole or in part, the validity of the other provisions and the remainder of the provision in question shall not be affected thereby.

9.8  The Agreement shall be governed and interpreted exclusively in accordance with the laws of Malta without giving effect to conflict of law rules. No other legal system will apply to the Agreement or to any Training Programme provided under the Agreement.

9.9  Any dispute, controversy or claim that may arise out of, or in connection with the Agreement or the execution, breach, termination or invalidity thereof, which cannot be resolved through amicable settlement, will be resolved exclusively in accordance with the laws of Malta. All legal proceedings will be submitted exclusively to the jurisdiction of a Maltese court.

Data Protection Notice

When providing the Training Programme to the attendee (“you” or “your”), PwC Academy Limited (C83602) and eSkills Malta Foundation (LPF-169) act as joint controllers of your personal data in terms of Regulation (EU) 2016/679 (“GDPR”).

The purpose of this present notice is to inform you how and why your personal data is processed in the context of this training programme. For any queries or complaints regarding data protection, please reach out to mt.gdpr@pwc.com.

1. Types of Personal Data Processed

When you register your interest or enrol for the training programme, the following personal data will be collected or otherwise processed:

  • Your contact details, namely your name, surname, and personal email address and telephone number;
  • Your country of residence;
  • Your Identity Card Number;
  • Your occupation;
  • Any further required information for the registration process, including date of birth, locality, nationality, and booked training;
  • Recordings or photos of the training sessions.

2. Purpose and Legal Basis for Processing

Your personal data will be processed for the following purposes:

  • To enrol you in the training programme, providing you access to the training materials, respond to any related questions or complaints, and settle any fees due, on the basis of Article 6(1)(b) of the GDPR. Please note that should you fail to provide the required information, you will not have access to the Training Programme;
  • Assessing the quality of the Training Programme, its content and the instructor’s proficiency, and providing you with information about other training courses, on the basis of Article 6(1)(f) of the GDPR;
  • Complying with any requirement of law or regulation to which the joint controllers are subject to (such as those relating to AML/CFT and tax), on the basis of Article 6(1)(c) of the GDPR; and
  • To promote the success and quality of the Training Programme, on the basis of Article 6(1)(a) of the GDPR. In this regard, please note that you may withdraw your consent at any moment in time by emailing mt.gdpr@pwc.com.

The joint controllers will not request special categories of personal data for enrolling you in the Training Programme. You may wish to disclose on your own such details to PwC Academy Limited on the basis of providing you with adequate arrangements for attending the training. Should this be the case, the processing of your personal data will be carried out on the basis of Article 6(1)(a) and 9(2)(a) of the GDPR.

3. Sharing of Personal Data

Your personal data may be shared between the joint controllers, to other PwC firms, subcontractors, educational bodies, and IT service providers in relation to any of the purposes set out in section 2 above.

Should some of these recipients be located outside of the European Union (EU), such transfers will be carried only: (i) to a country which provides an adequate level of protection for personal data; or (ii) under an agreement which covers the GDPR requirements for the transfer of personal data to third countries, such as the latest version of the standard contractual clauses approved by the European Commission. 4. Data Retention

Your personal data will be stored for no longer than necessary for fulfilling the purposes set out in section 2 above. As a rule of thumb, PwC Academy Limited stores personal data relating to registration details for a period of ten (10) years from the date of the training.

5. Data Protection Rights

You have the right to request from the joint controllers access to, rectification or erasure of your personal data, restriction of the processing of your personal data, and to object to the processing as well as the right to data portability. If you wish to exercise such rights, you may contact mt.gdpr@pwc.com.

Should you have any complaint on how your right request has been handled, or on how your personal data is processed in the context of the training programme, you have the right to lodge a complaint with the Office of the Information and Data Protection Commissioner at https://register.idpc.org.mt/report-breach/complaint/.
